  • 1. Approval of Plan

    Procedure

    (A) To Apply

    1. Login using User ID and Password (received after Online Registration).
    2. Select service “Approval of Plan”. No fees is required for submitting application for "Approval of Plan".
    3. Select CAF
    4. Fill up Part - A & B of CAF. (All fields to be filled up appropriately. Please write NA for fields where no information is to be mentioned.) CAF is saved in the “My application” after successfully filling up all the data in the CAF and uploading of documents.
    5. Scan and Save all documents mentioned under 'DOCUMENTS' including PLAN prepared as per the provisions laid down under The Factories Act. 1948 and the West Bengal Factories Rules 1958
    6. Select appropriate attachments/documents along with the filled up CAF.
    7. Select 'My Applications' (to follow instructions appearing on the Screen).
    8. Download earlier filled CAF from 'View & Print' option under "My Application/Returns",
    9. 'Digitally Sign' the CAF .
    10. Select 'Apply' from the 'My Application' section.
    11. Upload Digital Signed CAF.
    12. Select 'Submit' option to apply online.

    After successful submission of Application the system will generate Acknowledgement Receipt and unique Application ID for further reference and tracking.

    (B) To View and Track Status of Application

    1. Login using User ID and Password (received after Online Registration).
    2. Go to Dashboard
    3. Select applications whose status is desired to be checked in 'My Application' section under 'Details'.
    4. Check for necessary rectification, resubmitting / uploading further documents, if desired by the Department.
    5. Against 'Resubmit' instruction select 'Edit' option to resubmit CAF
    6. Against 'Upload/Reupload' documents instruction select 'Attachments', further select 'Reupload' option available under 'Attachments' to select desired documents. In case of requirement of additional documents by the Departments the 'Edit' option is to be selected to upload the said document

    (C) To View and To View / Download the Certificates

    (All certificates will come under the 'My Factories' section in the applicant's ''Dashboard')

    1. Login using User ID and Password (received after Online Registration).
    2. Go to Dashboard
    3. Go to 'My Factories' section and click on the click on 'Certificate'
    4. Select 'Download / Print' option as desired

    Documents

    1. Duly filled in Common Application Form (Part A & Part B)
    2. Flow chart of the manufacturing process along with brief description
    3. Authenticated copy of Consent to establish from WBPCB.
    4. Factory plan in duplicate for Kolkata/Howrah and 3 copies for regional offices.
    5. Declaration, duly signed by the occupier, stating whether any process or activity of the factory is a hazardous process as defined under section 2(cb) read with Schedule 1 of the Factories Act.1948 as amended.

    Flow

    (A) To Submit / Apply

    1. Go to Home Page
    2. Select "Online Apply" option
    3. Register as a new user by following guidelines
    4. Check for / Confirm receipt of User ID and Password on email
    5. Login by using the respective User ID and Password
    6. Select desired / appropriate service
    7. Follow according instruction as per 'PROCEDURE' for filling up and uploading CAF and other documents
    8. Upload Digital signature with the CAF when asked for.

    (B) To Monitor / Track application

    1. Login as before
    2. Go to Dashboard
    3. Check status of application under 'Details' of Respective Application in 'My Application' section for necessary rectification, resubmitting / uploading further documents, if desired by the Department.

    (C) To View / Download the Certificates

    1. Go to 'My Factories' section and click on the click on 'Certificate'
    2. Select 'Download / Print' option as desired

  • 2. Registration & Grant of Licence

    Procedure

    (A) To Apply

    1. Login using User ID and Password (received after Online Registration).
    2. Select service "New Licence & Registration".
    3. Provide Basic Details that will be asked for.
    4. 4a) Fill up Form-2 for Years preceding 2016 if Date of Amenability is in that period.
    AND/OR

    4b) Fill up Part - A & C of CAF for the years 2016 and thereafter (All fields to be filled up appropriately. Please write NA for fields where no information is to be mentioned). Form-2 and CAF will be saved in the "My application" section of applicant's Dasboard after successfully filling up all the data in the Form-2 and CAF and uploading of documents.

    Get information on the 'Fees' to be paid as per maximum no. of Workers employed/likely to be employed in each year, and installed machinery capacity from 'Fees Details' and make the requisite payment of Fees through "Make Payment option" available with Form-2 and CAF and enter the GRN and BRN along with date in the said column.

    5. Select appropriate attachments/documents mentioned under 'DOCUMENTS' (scanned and saved previously) along with the filled up CAF.
    6. Select 'My Applications' (to follow instructions appearing on the Screen).
    7. Download earlier filled CAF from 'View & Print' option under "My Application/Returns",
    8. 'Digitally Sign' the CAF .
    9. Select 'Apply' from the 'My Application' section.
    10. Upload Digital Signed CAF.
    11. Select 'Submit' option to apply online.

    Document

    1. Duly filled in Common Application Form in duplicate.
    2. Authenticated documents regarding deposition of fees.
    3. Authenticated copy of Consent to operate issued by West Bengal pollution control Board or a Declaration for Exempted Category industries as notified by West Bengal pollution control Board.
    4. Authenticated Copy of Purchase Deed/Lease Deed/Rent Receipt as the case may be in respect of the premises to be used as factory.
    5. Authenticated Copy of Trade Licence.
    6. For Limited and Private Limited company-Authenticated copy of Memorandum of Article of Association
    7. Declaration. Duly signed by the occupier. Showing the date of starting of manufacturing process (exact date) along with no. of workers engaged therein on that date and installed power, as applicable.
    8. List of machineries along with HP/KW duly signed by the occupier.
    9. Health and Safety policy, in case a hazardous process.

    Flow

    2. Select "Online Apply" option
    3. Register as a new user by following guidelines
    4. Check for / Confirm receipt of User ID and Password on email
    5. Login by using the respective User ID and Password
    6. Select desired / appropriate service

  • 3. Renewal of Licence

    Procedure

    (A) To Apply

    1. Login using User ID and Password (received after Online Registration).
    2. Select service "Renewal of Licence".
    3. Provide Basic Details that will be asked for.
    4. 4a) Fill up Form-2 for Years preceding 2016 if renewal is pending for those years and.
    AND/OR

    4b) Fill up Part - A & C of CAF for the years 2016 and thereafter (All fields to be filled up appropriately. Please write NA for fields where no information is to be mentioned). Form-2 and CAF will be saved in the "My application" section of applicant's Dasboard after successfully filling up all the data in the Form-2 and CAF and uploading of documents.

    Get information on the 'Fees' to be paid as per maximum no. of Workers employed/likely to be employed in each year, and installed machinery capacity from 'Fees Details' and make the requisite payment of Fees through "Make Payment option" available with Form-2 and CAF and enter the GRN and BRN along with date in the said column. Check for 'Late Fees / Penalty' as per date of payment before making the payment.

    5. Select appropriate attachments/documents mentioned under 'DOCUMENTS' (scanned and saved previously) along with the filled up CAF.
    6. Select 'My Applications' (to follow instructions appearing on the Screen).
    7. Download earlier filled CAF from 'View & Print' option under "My Application/Returns",
    8. 'Digitally Sign' the CAF.
    9. Select 'Apply' from the 'My Application' section.
    10. Upload Digital Signed CAF.
    11. Select 'Submit' option to apply online.

    4. Form-32 or other to substantiate change in List of Directors, if any (to be uploaded through 'Add Another Document' option)

    Flow

    3. Register as a new user by following guidelines
    4. Check for / Confirm receipt of User ID and Password on email
    5. Login by using the respective User ID and Password
    6. Select desired / appropriate service

(See Rule 19 of WBRTPS Rule)

Purpose: To provide approved plan to a factory in the State of West Bengal within the stipulated time limit under the West Bengal Right to Public Services Act, 2013 & rules framed there under.
Scope: Applies to all factories falling under the purview of the Factories Act, 1948 as amended in the State of West Bengal.
Procedure:
1. Persons authorised by the designated officer (as approved by the controlling officer) shall receive the application and issue acknowledgement in Form No.1 prescribed under The West Bengal Right to Public Services act. 2013 & rules framed thereunder, subject to receipt of the enclosures as per annexed checklist.
2. The designated officer as well as officers higher in rank as per existing office procedure shall scrutinize the plan and other documents and visit the site as per requirement.
3. Information regarding recommendation or rectification or rejection of a plan (with reasons stated thereof), as applicable during the entire process of plan scrutiny will be intimated to the applicant within the stipulated period of service.
4. Information regarding rectification shall be informed to the applicant by way of "Letter for rectification" which is to be complied by the applicant within 7 days of the issue of the same, so as to provide the aforesaid service within the stipulated period, failing which the application will be liable for rejection.
5. The rejection under this Act ( i.e. West Bengal Right to Public Services Act, 2013 ) shall not entail the applicant to claim any aberration from the provisions of the Factories Act, 1948 and Rules framed thereunder.
6. Once the application is rejected. the applicant will be required to submit a fresh application forthwith in compliance of the provisions of the Factories Act. 1948 and Rules framed thereunder.
7. Approved plan is to he collected from the Head office of the designated officer by the applicant or by his authorised representative.

7. Procedure and Checklist for Providing Service of Registration and Grant of Licence
